Importance Of Specifying Format Of Initial Edition

Here’s a contract tip that is both simple and yet can have a large consequence if not done.

As an agency, it’s been a long-time policy for our deals that publisher must specify initial publication format in the contract. For example, if a publisher wins a book at auction and part of them winning was a commitment to doing the book as a hardcover (for example), then when it comes time for publication, we don’t suddenly want the publisher to do the book as a trade paperback original instead.

One reason for this has to do with the author’s ability to earn out an advance. If a publisher paid a solid six-figures for something, the author is going to need the hardcover sales (with the higher price point) to earn out. Not to mention, with a hardcover initial edition, the author gets two publishing shots toward earn-out as the publisher, as a general rule, will publish the trade pb edition about a year later.

Makes sense.

Here’s another reason for specifying format of initial edition. As agents, we want to ensure that a publisher will do both a print AND electronic edition and not just publish a digital-only edition if that was not the original intent for accepting deal/contract. (Sidenote: Obviously, if an agent is selling a title to a digital-only publisher, then ebook only as initial format is understood.)

In this rapidly changing publishing landscape, and the rise of ebook sales, it is conceivable that a publisher buys a book with the intention of doing both formats and then decides later to not do the print edition and publish it only as an ebook.

I have not heard of this happening–yet. But why chance it?

Part of our job is to anticipate possible issues.

Traditionally, December is the month where publishing starts to quiet down as editors get ready to be away for the holidays. Kind of like how August tends to be an unofficial slow down period that then picks up after Labor Day.

If it’s true this December, I certainly can’t tell yet. We close next week but we are working like there is no holiday around the corner. Sara just wrapped up a deal earlier in the week. I’m announcing on Pub Lunch a deal I closed recently. I’m in the middle of two other negotiations–one of which was out of the blue from a publisher who couldn’t offer earlier in the year but now is.

Love that!

And lots of agents are obviously hard at work during this month as some fulls we’ve requested have gotten offers of representation–literally only days after receiving the actual manuscript.

So I would say it’s kind of like business as usual and probably will be right up until we close a week from tomorrow.

Potpourri And Funnies

STATUS: This week was defined but what wasn’t on fire with gasoline explosions. Seriously, I was coming to work each day with the thought: “Can just one thing not be an issue today? Just one.”

But I can also define this week by some really cool things.

1. Got a revised cover for an author who had a hideous cover just last week. New cover is awesome! I’m so pleased and relieved.

2. My colleague Sara held a big big auction for a middle grade boy fantasy novel that went in a major deal (THE PECULIAR by Stefan Bachmann). Squee.

And the best thing ever? Today my author’s editor had her baby and get this, she named the baby boy after a character in my author’s novel for whom she is the editor.

Okay, nothing beats that. That is just “Yes Way” cool.

And because it’s Friday, how can I not share with you www.awkwardfamilypetphotos.com? I read the article in PW, had to check it out. Huge Beverage alert. The below photo was hands down my favorite. Oi!

Singing To My Choir!

STATUS: Monday it was 80 degrees. Today it’s snowing. Tomorrow it will be sunny and in the high 50s. And beautiful again by the weekend. Not sure what shoes to keep out or put into storage.

So last week, in my status, I mentioned that we had received three covers and nixed three covers. So needless to say, it’s been nothing but cover talks, phone calls, and strategy ever since.

For the newer writers out there, an author does not get approval over covers unless he/she is at a very high level as an author. At NLA (and I imagine this is true for most agents), we always put cover consultation in the contract.

However, the definition of “consult” can be very loose. I’ve had some editors involve the author from the very first illustrative sketch to the final version. I’ve had some editors send it to the author when complete and simply say here it is. (To me, that’s not consult and I argue it.) For most editors, they are really invested in the author liking the cover so they actually allow a lot of input.

I’ve been lucky this week. The editors were fully supportive, nixed the covers and sent them back to the drawing board.

And then this morning, one of my authors sent me this link to PW’s Blog Shelftalker. I immediately read it and felt an overwhelming urge to say “Amen!” and “Keep singing my song!”

In the past weeks I’ve said everything mentioned here:

1. Misleading cover image that doesn’t remotely match the novel’s content.

Please, I beg you, for women’s fiction, no more pictures of pastoral objects like a bike or a hammock on a lovely sun porch. Debbie Macomber already has that cover thank you.

2. Same Old Cover Designs That Fit The Popular Trend.

I echo Elizabeth, please, no more covers of models in gowns, young women lying down, partial face images. When we got the ARE mailing of the “hot summer books” from a variety of young adult publishers, it was clear that any one title sent in that bunch was going to have trouble standing out. Every single one had a picture of a girl in some kind of dark, mysterious background or in a dark nature setting.

But I would like to add one to the list. No more jarringly ugly covers. I literally got a cover where the colors clashed so badly, I couldn’t figure out why somebody thought that color palette was a good idea.

Trust me, I’m not an art major or graphic designer but I am an avid reader and have seen my share of art through the ages. I know ugly when I see it.

In talking to one editor recently, I said, “all I have is my immediate gut reaction and right now, my gut says Oh Please No.

I could have kissed the editor when she said, “no prob; we’ll throw it out.”

Verdict Out On Whether A Good Idea Or Not

STATUS: For the last three days running, I’ve made it a goal to power through all the emails while I was at Frankfurt. I started out with 170. Made good headway but now for three days running, I’ve started with 130 emails and I still have 130 emails. Can’t shake the feeling of running in place….

As I was walking the Frankfurt Fair floor, perusing the booths on display, I stumbled upon a booth for a company called Booktrack. In short, they do sound tracks for electronic books.

Not sure what I think about that, so I figured I’d give it a listen.

The sample work on the floor was the short work IN THE SOUTH by Salman Rushdie. I popped on the earphones and gave it a listen as I read. There was ambient noise and sounds that connected with the text on the page.

Kind of reminded me of Spa on XM radio.

Did I think it enhanced the reading experience? The jury is still out on that for me.

Not Quite The American Export I’d Hope For

STATUS: TGIF! I haven’t seen a good funny (that I could share on the blog anyway) in ages. I need to rally the troops to send some my way again.

I was reading Publishing Perspectives this morning and came across an article that just made me groan. Of course there are scam artists all around the world but in general, the whole shady practice of pretending to be a literary agent and charging reading fees has been a pretty American concept.

Alas, not anymore.

Great. One of the things I’d prefer not to be an American export…. Not to mention, there are SO many more resources available online here in The States to help writers avoid the publishing-money-scam pitfall. I can’t imagine the same holds true in India. Perhaps I have some intrepid blog readers there who might help spread the word by posting links to the article or starting chats on the subject.

Nelson Literary Agency Has No Prob With LGBTQ

Holy cow! Can’t believe I missed this article yesterday. I’m so glad an agent friend forwarded to me. Take a moment to read it and tweet it on but in short, it’s an appeal to support literature with gay and lesbian characters and the fact that there are some appalling agents and editors out there who are making requests that the writers make a gay character straight.

Seriously? What year are we in?

I cannot tell you how delighted I was to see a link to a list of YA literature that features gay/lesbian characters and my author Sarah Rees Brennan’s THE DEMON’S LEXICON series was on it.

This author of mine is brilliant. It’s a wonderful series and her new trilogy that I just sold to Random House also has an absolute kick-a** gay/lesbian main character. The first book UNSPOKEN publishes in fall 2012.

Not to mention, I have a Monica Trasandes’ debut adult literary novel coming out in spring 2012 from Thomas Dunne Books/St. Martin’s Press. It’s called BROKEN LIKE THIS and features three main protagonists: a bisexual character, a gay/lesbian character and a straight male character (had to throw that last one in there-LOL).

A multicultural author to boot. I’ll tell you right now it was a tough sell but I loved the novel and I sold it.

So add these to your wish lists if you want to show support via your buying dollars. If I had cover art or anything yet for these two titles, I’d post it here but we are in the middle of the cover design and the buy links aren’t available online yet.

And let’s not forget the incredibly brilliant, witty, impeccably dressed and extremely powerful Lord Akeldama from Gail Carriger’s The Parasol Protectorate series.

I must admit it never occurred to me to add to my agency’s submission page that we are open to accepting material with LGBTQ characters because I kind of thought it went without saying but I’m rethinking it now.

Feel free to link to this blog post that it’s a-okay with us and I have NEVER asked an author to change a character’s ethnic background or orientation.

And because we are talking about multicultural too, check out my author Kimberly Reid’s debut YA novel MY OWN WORST FRENEMY. It’s an African-American urban Nancy Drew series. I mean, just how cool is that?

Story Of An Underdog

STATUS: Yesterday got away from me so I’m blogging “early” today.

Hum, I’m wondering if championing an underdog that then goes on to be successful might be the story of my career.

Either that or I simply have strange tastes most of the time (with the occasional hitting the market square on with a project that generates lots of initial excitement from the get-go).

So here’s another tale of an underdog–a novel that I absolutely loved but had trouble selling. And I can tell you that agents often delude themselves; I seriously expected an auction when I went out on submission with it. I was totally flummoxed when that didn’t happen.

But finally, after much work, this genre bending, doesn’t-fit-into-an-easy-category novel sold. I would call it a dark gothic Victorian historical romance with an unusual paranormal twist.

And I’m always telling aspiring writers not to do what I just did with my description above. LOL. Everything but the kitchen sink!

Given the nature of the story, the editor, author, and I all agreed that we needed to give the novel the best chance possible and one facet of doing that is going after established authors for praise blurbs to hopefully start the early buzz.

Now, the blurb process is not an easy one. In general, you’re lucky if maybe you get one or two blurbs out of 10 or 12 blurb read submissions. Established authors are on deadline, they get asked to blurb a million times, the story isn’t their cup of tea. There are a hundred reasons why established authors pass on reading for blurbs so you don’t go in with high expectation of the response. You’ll be happy with anything that comes of it. And a lot of times that means just one blurb.

Well, in this case, every established author we sent the novel to read it, loved it, blurbed it.

I’m still stunned. This never happens.

Gosh I hope the reading public feels the same! And if you are one of those readers that loves unique romances that don’t fit into neat square boxes, then all I can ask is that you add this one to your To Buy list because it almost didn’t happen. Editors WANT to take chances on unusual stories but it’s a tough argument for them at the editorial board meeting unless they can point to titles that were successful and sold well. That’s the cold, hard truth.

I’ve got high hopes that FIRELIGHT by Kristen Callihan will do just that.

What’s Hot Down Under

STATUS: I was very glad to hear that New York City didn’t get as hard from Irene as anticipated but my contacts on Long Island are still without power. Eep.

As I’m based in the U.S., it’s easy to get tunnel vision on what is hot because obviously I’m mostly focused on this territory. Now granted we sell a lot of projects abroad and some of our authors are wildly popular in places like Japan more so than in the US so I’m certainly aware of territorial differences but I still find it fascinating all the same.

So when I was in Australia, I had a chance to visit with a couple of editors. One publishing division was housed in a charming old Victorian-style mansion and others had sleek modern offices. I rather liked both settings.

Some things I learned took me by surprise. For example, in talking with ANZ children editors, they are still having a wonderful market for picture books. I don’t rep this genre (so please don’t send me queries for it) but I’ve heard any number of editors and agent friends who handle picture books in the US bemoan the state of trying to break out a new author in this arena. The climate is tough here but Down Under, they are still seeing really great success–even for new authors. This could partly be because the Indie bookseller market holds a significant sales percentage still in that country.

Two chain sellers–Borders and Angus & Roberson–had closed doors and editors were greatly concerned. With it went 20% of their sales market. In consequence, print runs were down by several 1000 depending on the author.

I was also surprised to see Costco in Melbourne and Sydney. I didn’t realize that company was there. (I also saw a few Targets). Interestingly enough though, neither venue sells books in Australia yet. I mentioned that it tended to be a strong sales venue in the US so I will be watching to see where that goes, if anywhere, there.

In ANZ, for young adult, dystopian has not taken off in a big way yet. HUNGER GAMES is certainly popular and they’ve had nice success with some other dystopian titles but no big break out. Well, let’s hope Marie Lu’s LEGEND will help jumpstart that trend. I’d appreciate it.

In a similar vein, paranormal romantic YA is equally hot there as it is in US (no surprise). What has gotten harder is literary YA–and that use to be a good market for them.

For middle grade, the ANZ publishers bemoaned the dearth of MG boy adventure stories (that sounds familiar!) and Wimpy Kid blew it out there. No surprise really. That’s a series that feels really universal.

In the adult realm, they publish a lot of Australian authors (as they should) and they always do it in trade paperback. There are very few hardcovers published there. They still love beautifully written stories so US imports like a recent debut THE LANGUAGE OF FLOWERS is having nice traction.

Another interesting tidbit is that an adult title called THE SLAP did mildly in the US but really broke out Down Under (and it was from an Aussie author so maybe no surprise) but it did well in Europe too.

Editors like what they call “watercooler” books. Fiction that tackles issues that readers can dig in and talk about around the proverbial watercooler.

That’s a wrap. By the way, this blog entry is not meant to be the end-all be-all of the ANZ literature market. It’s just smattering of random bits of info but I hope you enjoy it nonetheless.

Hard Wired For Conflict Equanimity?

Last Thursday, Angie and I got a chance to do informational interviews at the Denver Publishing Institute. As 2002 grads (and I can’t believe it’s been that long!), we were happy to give back by chatting with the graduating students looking for careers in publishing and specifically those who were interested in agenting.

I did about 15 interviews and during the day, I have to say that something completely crystalized for me.

Q: What does it take to be a good literary agent?

A: The ability to handle conflict.

Q: What does it take be a happy literary agent?

A: The ability to be sanguine about all the conflict you deal with on a daily basis.

I know. This should have been obvious but I had never boiled it down to the above. Ninety percent of agenting is troubleshooting and doing conflict resolution.

And I’m not exaggerating.

An agent’s job is to be the author’s advocate. Plain and simple. And that means it’s the agent’s job to sometimes be the “bad guy” so the author can have a warm and fuzzy relationship with his/her editor and publisher.

The agent is the person who says the tough things when they need to be said.

So if you are by nature, a conflict avoider, then being a literary agent is not going to be a happy job for you. It’s not like anyone loves conflict (or maybe some folks do!) but some folks are more hard wired to deal with it with equanimity.

Definitely something to keep in mind if you want to pursue this particular career.
